The European Court has decided that it's against
the valid law to prohibite the sale of medicine
via the internet, because it hinders the free
circulation of goods within the EU. The decision
of the European Court in Luxembourg might have
caused a big headache to the mighty Association
of German Pharmacies. The decision says that
it's allowed to prohibite the sale and distribution
of in Germany illegal medicines. But Germany
cannot however prohibite the sale of medicines
that are permitted even if done so via the internet.
The Association of German Pharmacies had sewed
the Dutch company DocMorris and the Dutch Pharmacist
Jacque Waterval, who distribute to their neighbour
country via the virtual net.
A big part of the public opinion never understood
this complaint, especially if you consider that
from January 1, 2004 in the ocntext of the Reform
of the public health service the internet was
foreseen as a official way of distribution.
With the begin of the new year you can buy all
medicines - on prescription or over the counter
- whererever you want to, provided that you
are allowed by law to do so. The responsibles
in the health sector hope to achieve savings
in the millions with the new system. Until now
you could buy prescription medicines only in
one of the 21,500 pharmacies that exist in Germany.
According to the Association of German Pharmacists
the presciption drugs make for the pharmacies
about 44% of the turnover and 70% of the profit.
